What is a Koopakte (Purchase deed)?

The written purchase agreement between the buyer and seller of a house. Other words for koopakte are koopcontract or koopovereenkomst (purchase contract or purchase agreement).

The content of purchase contract

Purchase contract includes the following:

  • Details of the buyer and seller 
  • Information about the house 
  • The purchase price and the security deposit 
  • Resolutive conditions

Provisional purchase contract

When you sign the purchase deed, you have a reflection period of three days. This is the preliminary purchase contract. This cooling-off period is laid down by law and applies to both buyer and seller. The cooling-off period can be extended in consultation with the seller, but this must be recorded in writing.

Resolutive conditions

The deed of sale also includes the resolutive conditions of the contract. The resolutive conditions are the valid reasons to refrain from buying or selling a home. Some examples of resolutive conditions are:

  • Not being able to get the mortgage or financing condition.
  • Not covered by the National Mortgage Guarantee. 
  • Not being able to get a residence or housing permit. 
  • The result of an architectural survey.

There are several additional costs associated with the purchase of a house. These one-time costs are called purchase costs.
Afsluitkosten (Closing cost)
"Afsluitkosten" refers to the closing costs associated with taking out a mortgage. These costs include commissions, appraisal fees, notary fees, and fees for applying for a National Mortgage Guarantee (NHG).
Bankgarantie (Bank guarantee)
When buying a house you will be asked for a bank guarantee. The bank guarantee is a guarantee that you, as the buyer of a house, must give to the civil-law notary.

Betalingstermijn (Term of payment)
The payment term is the periodic term in which you pay the interest, premium and possibly also the repayment.
Boeterente (Penalty interest)
Lenders charge a penalty if the mortgage is repaid earlier than agreed in the mortgage deed, for example when refinancing. With the penalty interest, the lender compensates for the lost income from the mortgage.
